s.59(2): basic wages plus the allowances the worker is entitled to, including the cash equivalent of concessional food. Excludes bonus and overtime itself. This is WIDER than the gratuity definition.

The hourly-rate basis

The Act fixes the overtime rate but not how a monthly wage becomes an hourly one. These two are common practice, not statute — change them to match your contracts.

Overtime payable

Overtime pay

₹2,500

10 hours at ₹250.00 per hour

Normal monthly hours
208
Ordinary hourly rate
₹125.00
Overtime rate (twice the ordinary rate, s.59)
₹250.00

Sustained across the month, these hours would exceed the forty-eight-hour weekly limit in s.51. Paying overtime correctly does not by itself make the hours lawful — the Act also caps total overtime in a quarter.

What this is based on

Factories Act, 1948s.51
No adult worker may be required to work more than forty-eight hours in a week.

Work beyond nine hours in a day or forty-eight in a week is payable at twice the ordinary rate of wages.
Factories Act, 1948s.59(2)
The ordinary rate of wages means basic wages plus allowances the worker is entitled to, including the cash equivalent of concessional food, but excluding bonus and overtime wages.
Minimum Wages Act, 1948s.14
Work beyond the notified normal working day is payable at the overtime rate fixed under that Act, for employment scheduled under it.

What is assumption, not law

The Act fixes the overtime rate at twice the ordinary rate, but does not fix how a monthly wage becomes an hourly one. The 26 days and 8 hours below are common practice, not statute — change them to match your own contracts.

This is a calculation tool, not legal advice. Statutory rates, ceilings and thresholds change — check the current position before relying on a figure for a payment. More on attendance in the resources below.
